Resumo O artigo desvela a funcionalidade da ideologia empreendedora presente na formulação política de acesso ao trabalho no cárcere. Compreende-se que esse tipo de trabalho também sofre os impactos da nova morfologia do trabalho. Argumenta-se que o encarceramento em massa é fruto do Estado penal. Considera ainda, que o acesso a políticas penais de trabalho no cárcere está constituído de contradições e expropriações de cunho neoliberal. O estudo conclui que o acesso minimiza a vida do indivíduo privado de liberdade e esconde as expropriações que interessam ao capital, evidenciando assim a lógica neoliberal. Abstract The article reveals the functionality of the entrepreneurial ideology present in the political formulation of access to work in prison. It is understood that this type of work also suffers the impacts of the new morphology of work. It is argued that mass incarceration is a result of the penal state. It also considers that access to penal labor policies in prison is constituted by contradictions and expropriations of a neoliberal nature. The study concludes that access minimizes the life of the individual deprived of liberty and hides the expropriations that interest capital, thus evidencing the neoliberal logic. state nature capital logic

ABSTRACT The article1 conducts a documentary research on laws, norms, decrees and regulations that constitute primary sources, chronologically dated in the 19th century, in order to answer the following problem: at what moment did the term minor started to characterize a labeling for boys and girls who lived in Empire Brazil and to constitute a basis for the tutelary practices that gained emphasis in the 20th century? The study aims to demonstrate that the 1927 Juvenile Code was enacted as a result of the minorism and part of a transnational movement that was born in the United States of America and circulated in Europe and Latin America. Differently from what was assumed, the research for the elaboration of the text concluded that the term minor - in the sense of minorism - was already used in Brazil, sparsely, in regulations from 1850 on, that is, almost 80 years before what the sources and the researches conducted pointed out, being the Minors Code the effect of minorism and not its creator.

RESUMO O artigo1 realiza uma pesquisa documental em leis, normas, decretos e regulamentos que constituem fontes primárias, datadas cronologicamente no século XIX, com vistas a responder à seguinte problematização: em que momento o termo menor passou a caracterizar um etiquetamento para meninos e meninas que viviam no Brasil império e a constituir uma base para as práticas tutelares que ganharam ênfase no século XX? O estudo objetiva demonstrar que o Código de Menores de 1927 foi promulgado como resultado do menorismo e parte de um movimento transnacional que nasceu nos Estados Unidos da América e circulou na Europa e na América Latina. Diferentemente do que se pressupunha, a investigação para a elaboração do texto concluiu que o termo menor - no sentido menorista - já era utilizado, no Brasil, escassamente em normativas a partir de 1850, ou seja, quase 80 anos antes do que as fontes e as pesquisas realizadas apontavam, sendo o Código de Menores o efeito do menorismo e não o seu criador.

Resumo: O artigo realiza uma análise histórica que perpassa três contextos: a) a colonização da América Portuguesa; b) o processo imigratório que se inicia no século XIX; e c) a política do Estado de bem-estar social do século XX. Os meninos como pajens e grumetes e as meninas como órfãs do rei foram presença constante nas embarcações dos séculos XVI e XVII. No século XIX, eles imigravam com suas famílias, como parte da política segregadora eugenista, que buscava o embranquecimento do país. No século XX, esse processo tomou como forma a ampla institucionalização de menores com vistas a conter os conflitos sociais. Para milhares de crianças, o Estado de bem-estar social foi uma política que as retirou de suas famílias e as inseriu no trabalho forçado. Assim, a existência de tráfico de pessoas por motivos econômicos e eugênicos não é algo recente, mas um processo vivenciado em outros momentos históricos, que continuou durante o século XX, não apenas na América Latina, mas também em países europeus como resultado da política de salvação da infância e do movimento parens patriae1 .

Abstract: The article carries out a historical analysis that crosses three contexts: a) the colonization of Portuguese America; b) the immigration process that began in the 19th century; and c) the policy of the 20th century welfare state. Boys as pages and cabin-boys and girls as orphans of the king were a constant presence on ships in the 16th and 17th centuries. In the 19th century, they immigrated with their families, as part of the eugenics segregation policy, which sought to whiten the country. In the 20th century, this process took the form of the broad institutionalization of minors with a view to containing social conflicts. For thousands of children, the welfare state was a policy that took them out of their families and into forced labor. Thus, the existence of human trafficking for economic and eugenic reasons is not something recent, but a process experienced in other historical moments, which continued during the 20th century, not only in Latin America, but also in European countries as a result of the policy of salvation of childhood and the parens patriae movement.

Resumo A maneira como os adolescentes percebem a educação recebida por seus pais, ou seja, os estilos parentais, afeta tanto no desenvolvimento cognitivo quanto no emocional. Este estudo teve como objetivo verificar as relações dos estilos parentais percebidos por adolescentes que cometeram atos infracionais, comparando com adolescentes sem esse histórico, e buscando associações entre emoções morais: orgulho, vergonha e culpa. Participaram 219 adolescentes em conflito com a lei e 243 não infratores. Responderam questionários contendo questões sociodemográficas e escalas que avaliam emoções morais e estilos parentais. A partir do Teste-t e qui-quadrado verificaram correlações significativas entre a dimensão exigência do estilo parental percebido e a prática de atos infracionais. Os resultados deste estudo apontam que a dimensão de exigência e os dois fatores de culpa podem atuar como proteção para o ato infracional, principalmente em adolescentes do sexo masculino.

Abstract The cognitive and emotional development of adolescents is affected by how they perceive their parents’ upbringing, or parenting style. This study aimed to verify the relationship between the perception of parenting styles by adolescents who committed transgressive acts and compare it to that of adolescents without such a history, also searching for associations with the moral emotions of pride, shame, and guilt. In total, 219 adolescents in conflict with the law and 243 non-offender adolescents participated in the study. They answered questionnaires containing sociodemographic questions and scales that assess moral emotions and parenting styles. The Chi-square and t-test were used to verify significant correlations between the demandingness dimension of the perceived parenting style and the practice of transgressive acts. Results revealed that the demandingness dimension and two guilt factors can act as protection against transgressive acts, especially in male adolescents.

Resumen La forma en la que los adolescentes perciben la educación recibida de sus padres, es decir, los estilos parentales, afecta tanto el desarrollo cognitivo como el emocional de ellos. Este estudio tuvo como objetivo verificar las relaciones de los estilos parentales percibidos por los adolescentes que han cometido actos infractores, comparándolos con adolescentes sin este historial, y buscando asociaciones entre las emociones morales: orgullo, vergüenza y culpa. Participaron 219 adolescentes en conflicto con la ley y 243 adolescentes no infractores. Todos respondieron cuestionarios con preguntas sociodemográficas y escalas que evalúan las emociones morales y los estilos parentales. Se utilizaron el test t y la prueba chi cuadrado para verificar las correlaciones significativas entre la dimensión exigencia de estilo parental percibido y la práctica de actos infractores. Los resultados indicaron que la dimensión de exigencia y los dos factores de culpa pueden influir como protección del acto infractor, especialmente para adolescentes del sexo masculino.
